Pune Techie Jailed For 5 years For Sharing Girlfriend’s Sex Video Online

PUNE: A 26-year-old software engineer was convicted and sentenced to five years in prison and a Rs 6 lakh fine by the court of additional sessions judge S P Ponkshe in Pune for publishing video recordings of his physical relationship with his girlfriend on various websites.

The woman would be compensated with Rs 5 lakh of the fine amount, according to the court. The convict was immediately brought into custody after the sentencing on November 30 and sent to the Yerawada central jail to serve his prison term.

This is the first conviction for an offence under Section 67-A of the Information Technology (IT) Act by a sessions court in Pune. Aside from that, the court found the accused guilty of possessing sexually explicit material in violation of Section 292 (2) (a) of the Indian Penal Code.

Judge Ponkshe based his decision on testimony from key prosecution witnesses such as the woman, her brother, and his friend (who first saw the obscene video clips on the internet), internet cafe owner, computer experts, and investigating officer Deepak Savant, among others, as well as the seizure panchanama of various electronic devices, which the accused admitted.

The prosecution proved that the accused “made and prepared the object in the electronic form i.e. videos of his sexual intercourse with the victim” and that the said videos were found in his possession as they were downloaded and recovered by the investigating officer under Section 27 of the Indian Evidence Act, according to the court.

The accused, on the other hand, was cleared of allegations of repeatedly rapping the woman on the premise of marrying her and cheating by making false promises between November 2009 and May 2010. The evidence presented by the woman revealed several occurrences of consenting physical interaction, according to the court.
